These Terms of Service ("Terms") govern your access to and use of the websites, products, and services provided by Ecomaze Inc. ("Ecomaze", "we", "us", "our"). By accessing or using the Services, you agree to be bound by these Terms.

1. Eligibility & Accounts

You must have authority to accept these Terms on behalf of yourself or your organization. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2. Subscriptions, Renewals & Cancellation

Access to certain features may require a paid subscription. Unless otherwise stated, subscriptions renew automatically at the end of each term until cancelled. You may cancel at any time, and your access will continue until the end of the then-current billing period. Fees are exclusive of taxes. We may adjust pricing or packaging upon notice.

3. Acceptable Use

• No unlawful, infringing, or harmful activities.
• No reverse engineering, unauthorized access, or interference with the Services.
• No sending of spam or unauthorized messages; comply with carrier and CTIA guidelines for SMS.

4. Customer Data & Privacy

You retain ownership of Customer Data. You grant Ecomaze a license to process Customer Data to provide and improve the Services. Our use of personal data is described in our Privacy Policy.

5. Third-Party Services

The Services may interoperate with third-party products (e.g., analytics, communications, payment providers). Use of those services is subject to their respective terms and policies.

6. Intellectual Property

We and our licensors retain all rights, title, and interest in and to the Services, including software, documentation, designs, and trademarks. You may not use our marks without prior written consent.

7. SMS Ecommerce Alert Service

By opting in to SMS order updates, you consent to receive recurring transactional SMS messages from Ecomaze Inc. regarding your ecommerce orders with businesses using the Ecomaze platform. These notifications include:

• Order Confirmations: Confirmation that an order was successfully placed.
• Shipping Notifications: Updates when an order is packed, shipped, or out for delivery.
• Delivery Notifications: Confirmation when an order has been delivered.
• Return/Refund Updates: Notifications about return processing and refund status.
• Price-Drop Alerts: Notifications when tracked products decrease in price.
• Discount Alerts: Promotional discount or coupon notifications for opted-in users.

Message frequency varies based on order activity. Transactional messages are event-driven. Promotional messages (including price-drop and discount alerts) are sent only with separate express consent. Message & data rates may apply. Reply STOP to cancel; HELP for help. Carriers are not liable for delayed or undelivered messages. Consent is not a condition of purchase or use of the platform.

8. Opt-Out of SMS

You may opt out of SMS alerts at any time by replying STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT to any SMS message you receive. Upon receipt of your opt-out request, we will process it immediately, cease sending SMS messages right away, and send a confirmation message.

9. Warranties & Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Services will be uninterrupted, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOMAZE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

11. Governing Law

These Terms are governed by the laws of Colorado, United States, without regard to conflicts of law principles. The courts of Colorado, United States shall have exclusive jurisdiction.
